MACEDONIAN ALLIANCE In accordance with Article 20. paragraph 1 and 2 of the Constitution of Republic of Macedonia and Article 9 of the law for political parties, the Inaugural meeting of Macedonian Alliance on 14th Jan. 1996 established STATUTE OF THE MACEDONIAN ALLIANCE
1. GENERAL REGULATIONS Article 1 This Statute defines the following : - the name and the main office of Macedonian Alliance - the goals and the missions of Macedonian Alliance and the way to their realization - conditions and way to accept new members in Macedonian Alliance and the rights, duties and responsibilities of members of Macedonian Alliance - internal organization - Macedonian Alliance bodies and their rights, authorization and responsibilities - way of deciding about acts (records) by Macedonian Alliance - way of using and spending the fund of Macedonian Alliance - representing Macedonian Alliance - openness in the work of Macedonian Alliance - way to decide about membership and cancellation of membership in international bodies, organizations and communities - way to decide about property and means of Macedonian Alliance in case of cancellation - way to decide about the Statute and changes and amendments in it - other issues
Article 2 Macedonian Alliance ( in the further text - Alliance) is a political subject which considering constitution guaranteed freedom of the citizens in Macedonia to form associations, provides protection and realization of political, economic, social, cultural and other rights and beliefs defined by the Program of the Alliance. Article 3 The Alliance acts as a juristic person with rights, competence and responsibilities defined in this Statute. 2. NAME AND MAIN OFFICE Article 4 The name of the Alliance is : Macedonian Alliance. The main office of Macedonian Alliance is in street “Naroden Front” no.5 local 7, Skopje, Republic of Macedonia. Article 5 The Alliance has a seal and a stamp. The seal has a round shape with diameter 3 centimeters with inscribed text in Macedonian in Cyrillic letters : Macedonian Alliance. In the middle there is a sun with a flower. The stamp has a rectangular shape with inscribed text in Macedonian Cyrillic letters : Macedonian Alliance, with space for record number and date.
Article 6 The Alliance has a flag and coat of arms. The flag of the Alliance is red and in the middle there is a golden yellow sun with a blue flower. The rate between width and length of the flag is two to three. The coat of arms is a shield with red part. In the middle of the shield there is a golden yellow sun with a blue flower. Article 7 The work of the bodies of the Alliance is carried in Macedonian language and Cyrillic letters. 4. GOALS AND MISSION OF THE ALLIANCE Article 8 The main goals of the Alliance are : - to take over state control and local and community self-governing in Republic of Macedonia - to take part in executive public functions in the state - to take part in electoral proceedings for President of Republic of Macedonia, in the electoral proceedings for delegates in the Parliament of Republic of Macedonia (Sobranie na RM) and in the electoral proceedings for representatives in the bodies of local and community self-governing system and - to take part in the authorities Article 9 The Alliance will use every democratic means and methods in achieving its goals and mission; the Alliance will cooperate with physical and juristic persons in the country and abroad. Article 10 Members of the Alliance will realize goals, mission and the Program by taking part directly or through their representatives in the bodies of the Alliance, in the institutions of state authorities, local and community self-governing system; they will take a part in the activities and measures of the Alliance by taking part in the work of the Alliance and by realization of cooperation and international activities of the Alliance. Article 11 In realizing the goals, mission and Program the Alliance can : - establish separate bodies, organizations, communities, institutions and associations; - engage temporary or permanent scientific and expert institutions, professionals and cooperators; - use the services of its members; - make coalition with other political subjects Article 12 Documents of the bodies and organizations of the Alliance must be in accordance with this Statute. 4. CONDITIONS AND MEMBER ACCEPTANCE IN THE ALLIANCE; RIGHTS, DUTIES AND RESPONSIBILITIES OF THE MEMBERS OF THE ALLIANCE Article 13 Any adult citizen of Republic of Macedonia who lives in Republic of Macedonia can be a member , regardless of sex, race, ethnic or social origin, religious persuasion, wealth or social position and a person who accepts the goals, mission and Program and this Statute of the Alliance. Article 14 Alliance Membership is free and voluntary and valid upon signing admission declaration. Each member must pay membership fee fixed by a decision of the National Committee of the Alliance. All members will receive a membership card defined by the Presidency of the Alliance. Article 15 Membership of the Alliance stops by individual wish or by a decision of competent bodies of the Alliance and in a way defined in this Statute and a separate act. Article 16 All Alliance members have rights and duties to realize the goals and mission and engage themselves in their realization; also the Program and Statute of the Alliance regarding to their authorizations, possibilities and capabilities , in particular : - to lead the work of the Alliance, to choose, authorize and cancel the bodies of the Alliance and supervise their work - to use legal, expert and other help and services done by the Alliance - to make initiative and suggestions in order to realize the goals and mission and Alliance Program - to take part in the measures and activities of the bodies, organizations of the Alliance - to take part in money raise to realize the goals and mission, Program and this Statute of the Alliance - to work actively in raising the number of members and followers of the Alliance - to follow the regulations of this Statute and the acts of the bodies of the Alliance The Alliance member can only be a member in one local, regional, community and city organization. Article 17 In case a member acts contrary to the regulations for rights and duties (defined by this Statute ) and behaves and acts improperly at work and in his circles, the Alliance can undertake discipline measures against the member : written reminder, written reminder before the member is annulled and annul the member of membership of the Alliance. The discipline measures in paragraph 1 of this Article to a member of a local organization can be decided by the local committee, regional committee, community committee, city committee and National committee of the Alliance. The discipline measures in paragraph 1 of this Article to a member of the bodies of the regional organization can be decided by the regional committee, community committee, city committee and National committee of the Alliance. The discipline measures in paragraph 1 of this Article to a member of the bodies of the community organization can be decided by the community committee, city committee and National committee of the Alliance. The discipline measures in paragraph 1 of this Article to a member of the bodies of the Alliance can be decided by the National committee of the Alliance. Article 18 Responsibility of members of the Alliance and representatives in the bodies of the Alliance is determined based on undertaken responsibilities and statute authorizations and competence according with this Statute and a separate document brought by National committee of the Alliance. 5. RULING AND DECIDING IN THE ALLIANCE Article 19 Work of the Alliance is ruled by its members directly through their representatives in the bodies and other forms of organization and influence of the Alliance; in a way and procedure defined by this Statute and other documents of the bodies of the Alliance. Article 20 Representatives of the bodies of the Alliance : - they are elected from the members of the Alliance in a way and procedure defined in this Statute and with a separate document brought by the National committee of the Alliance - they work according to the instructions of the members or bodies which have chosen or authorized them and they are responsible to these members or bodies; they must respect the interests of the members of the Alliance on the whole, or when determining common or general interests in Alliance bodies. - they decide according to their persuasion - they have rights and responsibilities for their work and the work of the body or Alliance organization they are members of; and inform this organization they have been elected or authorized by. Article 21 Mandate of representative of a body of Alliance is canceled before the period in which he has been elected or authorized in case : - expelled or annulled by Alliance body which has elected or authorized the member - submit written resignation from the post of member of the body, i.e. of the organization elected or authorized by - in case of death of a member
Article 22 About the issue to annul a member (bearer of a function) of the Alliance decides the body which has elected or authorized the member on the session when the issue is introduced; about the issue introduced between two sessions , it is decided by the body which has elected or authorized the member at the next session of the body. When a resignation from the post - bearer of a function of the Alliance is submitted, it is decided by the body which has elected or authorized the member at the session when the resignation has been submitted; the resignation submitted between two sessions is decided by the body which has elected or authorized the member at the first session of the body. There is not any discussion about the resignation. The president of the body informs the body about the submitted resignation and the members accept the submitted resignation. Suggested by a member of the body, it can decide to bring up for discussion this resignation. In case of paragraph 6 of this Article the body can : - reach a conclusion to promote or arrange the relations in the field in which the submitter of resignation was responsible - criticize the work of submitter of resignation and recommend him for his work - determine responsibility of submitter of resignation In case the body determines responsibility of submitter of resignation, his function mandate stops under the regulations of this Statute. In case submitter of resignation is president of a body of the Alliance, at the next session of this Alliance body ,called by his deputy, new person will be elected for this position. In case there is not a deputy the session is called by the oldest member of this Alliance body, in 9 days from the day of resignation submission or as soon as conditions are fulfilled. 6. INTERNAL ORGANIZATION 6.1. Local organization Article 23 Basic form of territorial organizing of Alliance in the unit of local community is local organization. All members of Alliance who live and stay in the area of that unit are part of that local organization of self-governing. At the local organization members of Alliance can create and provide conditions to protect, affirm and realize Alliance interests and interests of members of local organization in the area of the unit of local self-governing. Bodies of local organization are : Local Conference, Local Committee, President, Presidency, Local Council and Supervising Board. Regulations of this Local organization are brought by national Committee of Alliance. Local organizations are established; their areas or boundaries are determined by a decision of the Presidency of Alliance. For one local community at least one Local organization is established. 6.2. Regional organization Article 24 Basic from of territorial organizing of Alliance in voting unit for delegate at the Parliament of Republic of Macedonia is Regional organization. All members of Alliance who live and stay in the area of that voting unit take part in elections for delegate at the Parliament of republic of Macedonia. At the Regional organization members of the Alliance create and provide conditions to protect, affirm and realize Alliance interests and members of Alliance at the Regional organization on the territory of the voting unit for delegate at the Parliament of Republic of Macedonia. Regional organization bodies are : Regional Conference, Regional Committee, President, Presidency, Regional Council and Supervising Board. Regulation of Regional organization are brought by National committee of Alliance. Regional organizations are established; their areas or boundaries are determined by a decision of the Presidency of Alliance. For each separate voting unit one Regional organization is established. In case at a separate voting unit for delegate at the Parliament of Republic of Macedonia there is only one Local organization, it carries out the functions, rights, competencies and responsibilities of the Regional organization for that voting unit for delegate at the Parliament of Republic of Macedonia, determined by this Statute and Regulations of Regional organization.
6.3. Community organization Article 25 Basic from of territorial organizing of Alliance in the community is Community organization. All members of Alliance who live and stay in the area of that community take part in that Community organization. At the Community organization members of the Alliance create and provide conditions to protect, affirm and realize Alliance interests and members of Alliance at the Community organization on the territory of the community and community bodies. Community organization bodies are : Community Conference, Community Committee, President, Presidency, Community Council and Supervising Board. Regulation of Community organization are brought by National committee of Alliance. Community organizations are established; their areas or boundaries are determined by a decision of the Presidency of Alliance. Foe each community one Community organization is established. In case of one Regional organization in a community, it carries out the functions, rights, competencies and responsibilities of the Community organization for that community determined by this Statute and Regulations of Community organization. In case of one Local organization in a community, it carries out the functions, rights, competencies and responsibilities of the Community organization for that community determined by this Statute and Regulations of Community organization. 6.4. City organization Article 26 Basic from of territorial organizing of Alliance in the city Skopje is City organization. All members of Alliance who live and stay in the area of Skopje take part in the City organization. At the City organization members of the Alliance create and provide conditions to protect, affirm and realize Alliance interests and members of Alliance at the City organization on the territory of Skopje and bodies of the city of Skopje. City organization bodies are : City Conference, President, Presidency, City Committee, City Council and Supervising Board. Regulation of City organization are brought by National committee of Alliance. 7. ALLIANCE BODIES; THEIR RIGHTS, COMPETENCIES AND RESPONSIBILITIES
Article 27 Alliance bodies are : Congress, National Committee, President, Presidency, National Council and Supervising Board. 7.1. CONGRESS Article 28 The Congress is the highest representative body of the Alliance. The Congress is called every fourth year and in cases determined by this Statute and other documents of National Committee. The Congress consists of President, Vice-presidents, members of Presidency and General Secretary of Alliance, President of Macedonian Youth Alliance, delegates at the National Committee, councilors at the National Council, members of Supervising Committee, delegates at the Parliament of Republic of Macedonia of the Alliance, the Prime Minister and ministers in the Government of Republic of Macedonia of the Alliance and mayors of communities and the city of Skopje of the Alliance (in the further text : delegates) and certain number of delegates determined by the National Committee. Congress organization and functioning is determined by this Statute and Congress protocol. Article 29 The Congress works at plenary sessions and separate sessions. The Congress calls the President of Alliance based on a decision of National Committee and when majority Community organizations require it. The Congress is called in the period of 90 days before the date of its session. The decision about the Congress includes itinerary, place, day and hour of session and materials which are subject to revision at the Congress. The decision to call the Congress together with the materials which are subject to revision at the Congress are sent to the Congress delegates not later than 50 days before the day of the session. The Congress decides about a protocol with majority of votes of the total number of delegates. The Congress delegates represent the members of the Alliance and decide according to their persuasion, in accordance with the regulations of this Statute. Article 30 The Congress decides : 1) passes the Statute and changes and amendments of the Statute of Alliance 2) passes a Program of Alliance and changes and amendments of Program 3) passes Work protocol of Congress 4) adopts work report of Alliance in the period between two Congresses 5) adopts work report of Supervising board between two Congresses 6) gives authentic explanation of paragraphs of Statute and documents of National Committee and Alliance 7) forms permanent and temporary working bodies of Congress 8) undertakes activities and measures for realization of goals and tasks of Alliance Program 9) elects and annuls Alliance President 10) elects president and members of Supervising Committee of Alliance 11) makes elections, authorizations and annuls bearers of functions defined with this Statute and another act of Congress 12) performs other functions The Congress passes statutes, decisions, declarations, resolutions, decides about direction, recommendations, paragraphs, conclusions and other regulations ( in the further text : acts) in its work . The Congress can transfer certain acts, measures and activities (defined in paragraph 1 of this Article ) to another Alliance body. Article 31 The Congress can work if majority of total delegates number is present at the session. Congress decides with majority of votes of present members, unless different majority is defined by this Statute. The Congress decides by a public vote. The Congress decides with a secret vote in case the Congress accepts a suggestion from a delegate, as well as the questions which this secret vote was accepted for by this Statute. The Congress can stop the work, but it must previously determine date and place of continuation which is announced in presence of the delegates.
Article 32 The right to suggest passing an act and submit a suggestion, as well as the right to suggest candidates and annul bearers of functions of Alliance has any delegate of Congress, President, Presidency, National Council and National Committee.
7.2. NATIONAL COMMITTEE Article 33 The National Committee is the highest administrative body of Alliance between two Congresses. The National Committee consists of President, Vice-presidents, members of Presidency and General Secretary of Alliance, President of Macedonian Youth Alliance, presidents of city, community and regional organizations, delegates of Parliament of Republic of Macedonia of the Alliance and the Prime Minister and Ministers at the Government of Republic of Macedonia and city mayors of city of Skopje and communities of the Alliance (in the further text : delegates). National Committee organization and functioning are defined by this Statute and work protocol of National Committee. Article 34 The National Committee works in sessions. The sessions of the National Committee are called by Alliance President by his initiative or when required by at least one third of Presidency members; at least one third of delegates at the National Committee or at least one third of community organizations. At a session of National Committee members of National Council and Supervising Board of Alliance take part, but without the right to decide, except delegates of the National Committee. The National Committee passes Work Protocol with majority of votes of the total number of delegates. Article 35 The delegates of the National Committee represent the members of Alliance and decide by their own belief, in accordance with regulations of this Statute. The delegates of the National Committee are elected for the period of four years, with a possibility to be reelected in a way and procedure defined by this Statute. The Newly elected National Committee meets at a constitutive session not later than 90 days after Alliance elections. The constitutive session is called by the President of Alliance. In case a constitutive session of National Committee is not scheduled in the expected time , members of National Committee will have a meeting at Alliance main office and they will constitute the National Committee on 91st day, starting from the first day after the date of Congress session. The elections of delegates of National Committee of Alliance will get held in the period of last 90 days of the mandate of the old members. The National Committee can change conditions defined in paragraphs 3 and 4 of this Article in case of justified reasons.
Article 36 The National Committee : 1) passes Work Protocol of National Committee 2) passes a decision about scheduling the Congress and decides about suggested documents of Congress 3) passes regulations for candidate for President of Republic of Macedonia 4) passes regulations for candidates for delegates at the Parliament of Republic of Macedonia 5) passes regulations for determining candidates for representatives at the city bodies of Skopje 6) passes regulations for determining candidates for representatives at the bodies of local communities self-governing units 7) passes regulations for determining candidates for representatives at the bodies of community units 8) interprets authentically regulations of this Statute and acts of National Committee of Alliance 9) determines membership fee, way to be paid and distribution of means, i.e. determines the system of financing the Alliance 10) decides about membership or cancellation of membership of Alliance in international bodies, organizations and communities, institutions and other associations 11) forms permanent or temporary working bodies of Alliance 12) undertakes measures and activities to realize goals and tasks of Alliance Program 13) decides about members to be annulled of the Alliance 14) elects and annuls vice-presidents to a suggestion of Presidency of Alliance 15) elects and annuls members of National Council of Alliance suggested by President of Alliance 16) elects and annuls general secretary suggested by Alliance Presidency 17) announces members of Presidency to President suggestion 18) decides about making coalition with other political subjects 19) decides about ratification of acts where Alliance is signatory 20) elects, authorizes and annuls bearers of functions defined by this Statute and other act of National Committee 21) decides about the budget and annual balance sheet of Alliance for each year 22) performs other tasks defined by this Statute The National Committee passes statute, regulations, declarations, decisions, resolutions, decides about direction, recommendations, paragraphs, conclusions and other regulations ( in the further text : documents) in its work . The National Committee can transfer certain acts, measures and activities (defined in paragraph 1 of this Article ) to another Alliance body. Article 37 The National Committee can work if majority of the total number of delegates is present at the session. The National Committee decides with majority of votes of present members, unless different majority is defined by this Statute. The National Committee decides by public vote. The National Committee decides with a secret vote in case the National Committee accepts a suggestion from a delegate, as well as the questions which this secret vote was accepted for by this Statute. Article 38 The right to suggest passing an act and submit a suggestion, as well as the right to suggest candidates and annul bearers of functions of Alliance has any delegate of National Committee, the President, Presidency and National Council.
Article 39 Mandate of a delegate of National Committee stops when he is convicted for crime for which he is punished with imprisonment of at least 5 years. Mandate of a delegate of National Congress can be annulled in case when he is convicted for crime or other illicit action which makes the delegate incapable for performing the function of a delegate, as well as unjustified absence from the National Committee for the period of more than 6 months. Membership annulling is determined by National Committee i.e. two thirds of the total number of delegates of National Committee.
7.3. PRESIDENT OF ALLIANCE Article 40 The Alliance has a President. The President of Alliance performs his rights and duties in accordance with and in the frames of the Program and this Statute and acts of National Committee. The President represents the Alliance, presides over the sessions of National Committee, National Council and Presidency, cares about changes of this Statute, Protocol of National Committee, Protocol of National Council and performs other duties defined by this Statute, by the Protocol of National Committee, by the Protocol of National Council and acts of National Committee. In case of temporary disability or absence of the President, one of the members of Presidency replaces him according to previously determined schedule of the Presidency. Article 41 Acts of Alliance bodies are signed by the President. The President of Alliance may decide not to sign an act of Alliance. In such case, the competent body will discuss the act again and pass by two thirds of votes of the total number of members; in this case the President is obliged to sign the act.
Article 42 The Congress elects Alliance President by a secret vote for a period of four years; reelection is possible. Alliance President candidate can be suggested by at least one third of total number community organizations of Alliance or at least 30 delegates of Congress. One delegate of Congress can be a signer to only one candidate list for President. President becomes the candidate who receives the majority of votes of the total number of delegates of Congress. In case when after the first vote neither of candidates for President has received the optimal majority of votes, in the second vote the delegates vote for two candidates who has received the majority of votes. The second vote is made after the first one. In case when after the second vote neither of candidates for Alliance President has received the optimal majority of votes, the voting procedure is repeated until election for President is finished, in accordance with regulations of this Statute. If the candidate suggested for President has not received the majority of votes at the first voting, the whole voting procedure is repeated until the election for President is finished, in accordance with regulations of this Statute. Before the President of Alliance takes over the duties, he gives and signs an official statement at Congress as follows : “I declare that the position of President of Alliance I will do conscientiously and responsible and I will follow the Program, Statute and documents of Alliance bodies and I will devote myself to sovereignty and independence of Republic of Macedonia as a new Macedonian state, I will respect its territorial integrity and protect the dignity and reputation of Macedonians by origin and citizenship in the whole world.”
Article 43 Alliance President : 1) cares about application of Program, this Statute and Alliance acts 2) gives instructions and direction to execute goals and tasks of the Program of Alliance and the General Secretary and the Expert group of Alliance. 3) decides about instructions, acts and other work regulations about the work of General Secretary 4) decides about instructions, acts and other regulations to execute acts of Alliance bodies 5) takes care for realization of cooperation of international activities of Alliance 6) calls sessions of National Committee, National Council and Presidency and presides over them 7) suggests passing of acts and suggests acts to National Committee, National Council and Presidency of Alliance 8) coordinates work between Alliance bodies and bodies and organizations established by Alliance, as well as organized groups of Alliance 9) takes care about organization and cooperation of Alliance with Government, non governmental, national and international bodies and organizations 10) does other work and tasks defined by this Statute and Alliance bodies acts. Article 44 The Alliance has two vice-presidents. Vice-presidents are elected and annulled by national Committee for a period of four years, to suggestion of the Presidency, re-election is possible. Vice-presidents help the President with his work and agreed with the President perform certain work in his competence. In case of absence of President, one of the vice-presidents substitutes his by written authorization of the President.
7.3. PRESIDENCY OF ALLIANCE Article 45 The Alliance has Presidency. Presidency is executive and operational body of Alliance. Presidency consists of President, vice-presidents, members of Presidency and General Secretary of Alliance. Presidency executes its rights and duties in accordance with and in the frames of this Statute. The organization and functioning of Presidency is defined by this Statute, Presidency Protocol and National Committee acts.
Article 46 Presidency of Alliance : 1) cares about application of Program, this Statute and Alliance documents 2) decides about Protocol of Presidency 3) cares about work coordination of city, community, regional and local organizations of Alliance 4) takes care of realization of cooperation and international activity of Alliance 5) takes care about informing the delegates and members of Alliance 6) induces cooperation of Alliance with authorities of Republic of Macedonia 7) decides about sending delegations and determines delegation members of Alliance and decides about making receptions of delegations at the Alliance 8) forms temporary and permanent working bodies and engages individuals to execute goals and tasks of the Alliance 9) selects candidates for vice-presidents and General Secretary by two thirds of majority the total number of members, to Alliance President suggestion 10) gives instructions and direction to execute goals and tasks of the Program of Alliance to the General Secretary of Alliance. 11) decides about instructions, acts and other regulations for the work of General Secretary and Secretaries and Secretariats of city, community, regional and local organizations 12) suggests passing of acts and suggests acts to National Committee and National Council 13) decides after the suggestions for admission at the Alliance and cancellation of membership of Alliance 14) determines plan of budget and draft of annual balance sheet of Alliance for each year 15) does other work and tasks defined by this Statute and Alliance bodies acts.
Article 47 Presidency works at sessions; majority of votes of the total number of members is decisive; exception is made in case there is a different majority defined by this Statute. Presidency sessions are called by Alliance President. At the sessions of Presidency the President presides over.
7.5. NATIONAL COUNCIL Article 48 Alliance has National Council (in the further text : Council). The Council is executive body of Alliance. Council consists of President, vice-presidents, General Secretary and President of Macedonian Youth Alliance, Prime Minister and ministers at the Government of Republic of Macedonia of Alliance and certain number of members for specific branches and issues (in the further text : councilors) ; the number is not limited and is determined by a National Committee decision, to Presidency suggestion. Councilors supervise the councils for certain fields and issues. The Council executes its rights and duties in accordance with and in the frames of this Statute. The organization and functioning of Council is defined by this Statute, a separate act passed by the National Committee and suggested by the President. Councilors are authorized and annulled by National Committee suggested by the President. Councilors may be members of Alliance bodies, but not obligatory. Article 49 Council works at sessions. Sessions of Council are scheduled by the President and he presides over them. Article 50 Councilors of Council decide according their belief in accordance with regulations of this Statute. Councilors of Council are elected for a period of four years; re-election is possible by a procedure defined in this Statute. Councilors election at the Council is made at a session of the National Committee at least 30 days of each election of Alliance President. National Committee may change regulations stated in paragraph 3 of this Article in case of justified reasons.
Article 51 Council : 1) determines the policy of act execution of Congress, National Committee and Presidency and passes regulations and other acts and their execution 2) appoints and annuls members of councils which are supervised by councilors of Council 3) passes and act for internal organization and systematization of works and tasks of councils and other permanent and temporary working bodies and directs and supervises their work 4) performs other work defined by this Statute and acts of Congress, National Committee and Presidency The Council performs duties of its competence, passes decisions, declarations, resolutions, directions, recommendations, advice, conclusion and other regulations (in the further text : acts).
Article 52 The Council can work if majority of total number of councilors are present at the session; it decides by majority of votes of present councilors , exception is made in case there is a different majority defined by this Statute. 7.6. SUPERVISING BOARD Article 53 The Alliance has a Supervising Board. The Supervising Board is elected and annulled by Congress for the period of four years; re-election is possible. Supervising Board consists of president and two members. President and members of Supervising Board can not be members of other bodies of Alliance at the same time. Supervising Board supervises and controls material and financial work and submits a report for the finished control in written form to National Committee at least one time a year. Supervising Board works at sessions called and presided by President of Supervising Board. 8. YOUTH ORGANIZATION Article 54 Alliance has youth organization. Youth organization members can be of age 18 to 27. The name of youth organization is : Macedonian Youth Alliance. The work of Macedonian Youth Alliance is determined by Regulations brought by National Committee.
9. GENERAL SECRETARY Article 55 The Alliance has General Secretary. General Secretary is elected and annulled by National Committee to President suggestion , for a period of four years; re-election is possible. General Secretary candidate is not obliged to be Alliance bodies member. General Secretary performs the following duties : 1) helps Alliance President to prepare for sessions of Alliance bodies 2) helps President of Supervising Board to control and prepare sessions of Supervising Board 3) organizes and follows execution of operational and political position, decisions and conclusions of Alliance bodies 4) organizes internal life in the party 5) organizes the work and takes care of property and means of Alliance 6) performs other work and tasks given by the President General Secretary is responsible for his work in National Committee and the President.
10. MEANS FOR WORK OF ALLIANCE Article 56 Means for work of Alliance are provided from membership fees paid by its members, sale of products and services, sale of publications and information, voluntary contributions, gifts, inheritance, donations, sponsorship and other sources stated by the Law for political parties and valid financial regulations of Republic of Macedonia. Means of Alliance are used to realize the goals and tasks and Program of Alliance in accordance with Alliance budget. Membership fee for each member is fixed and is paid in a way defined by a decision of Presidency of Alliance.
Article 57 Alliance has bank account in the city where its main office is at a bank determined by Presidency. Signer of bank account and person giving orders for material and financial work of Alliance is President of Alliance. Alliance can have more signers of bank account is decided by Presidency. 11. REPRESENTING ALLIANCE Article 58 Alliance is represented by President of Alliance. Alliance can be represented by another person when decided by Presidency by a separate and nontransferable authorization to a third person for a specific work or task fro a definite period of time. This authorization (paragraph 2 of this Article ) defines transfer of type, volume and period of authorization for representing. 12. OPENNESS IN THE WORK OF ALLIANCE Article 59 The work of Alliance is open. Openness in the work of Alliance is provided by open sessions of Alliance bodies, issuing special information sheets, as well as other ways of public informing. Alliance has one or more newspapers and uses other public papers and media.
13. DECIDING ABOUT MEMBERSHIP AND RESIGNATION FROM MEMBERSHIP IN INTERNATIONAL BODIES, ORGANIZATIONS AND COMMUNITIES Article 60 The decision about membership and resigning from membership of Alliance in international bodies, organizations and communities is brought by National Committee by majority of votes of the total number of delegates suggested by Presidency or at least one third of the total number of delegates of National Committee. Article 61 International and other agreements on behalf of Alliance are signed by President of Alliance. International and other agreements are ratified by National Committee of Alliance.
Article 62 President and Presidency of Alliance take care about realizing international and other cooperation of Alliance. 14. MAKING DECISIONS IN CASE OF ALLIANCE CESSATION AND HANDLING PROPERTY IN CASE OF CESSATION Article 63 Alliance stops work : 1) in case of prohibited activities by a legal decision by a competent court 2) when Constitutional Court of Republic of Macedonia establishes that its Program or Statute are not in accordance with the Constitution 3) when e decision for cessation of Alliance is made by National Committee by two thirds of votes of the total number of members 4) when the number of members is less than 500 members In case of cessation stated in 3 and 4 of paragraph 1 of this Article, the person representing Alliance must inform Appellation Court in Skopje to cancel it from court register in period of 15 days counting from the day of cessation. In case of cessation of Alliance, only legal inheritor of property and means of Alliance is Macedonian Orthodox Church.
15. ECONOMIC AND OTHER ACTIVITIES Article 64 Alliance may establish legal and other subjects to perform economic and other activities under conditions defined by the law to self- finance of its activities and realize goals and tasks of Alliance Program.
16. PASSING STATUTE; CHANGES AND AMENDMENTS OF STATUTE Article 65 Alliance Statute is changed and amended by amendments.
Article 66 Suggestion for passing a new Statute and suggestion for changes and amendments of this Statute can be determined by two thirds of the delegates of National Committee and Presidency of Alliance. The decision for passing a new Statute or the decision for changes and amendments of this Statute is brought by National Committee by majority of votes of the total number of delegates of National Committee.
Article 67 Draft of new Statute or plan of changes and amendments of this Statute are determined by National Committee and to Presidency suggestion; it is done by majority of votes of the total number of delegates of National Committee and introduces it to open discussion of Alliance members. The open discussion is made at least 30 days (maximum 180 days) of the day of determining the plan , decided by National Committee. The suggestion fro a new Statute, i.e. suggestion for changes and amendments of this Statute in the period of 30 days after the open discussion on the plan is determined by National Committee to Presidency suggestion.
Article 68 The new Statute, i.e. changes and amendments of this Statute are determined by Congress to National Committee suggestion. Congress separately determines the text of each paragraph (Article) of suggested new Statute, i.e. suggested changes and amendments of this Statute by majority of votes of the total number of delegates of Congress. Decision about passing the new Statute i.e. the decision about changes and amendments of this Statute passes the Congress by majority of votes of the total number of delegates of Congress. Alliance must inform Appellation Court about changes and amendments of Statute and Program in period of 30 days and submit the minutes of session when adopted and are applied after registration at court register of political parties. 17. OTHER REGULATIONS Article 69 Members of National Committee will be amended according to the dynamism of establishment of city, community and regional organizations in accordance with this Statute. Presidency performs the rights and duties of National Committee defined by this Statute until the National Committee is constituted.
18. FINAL REGULATIONS Article 70 Issues which are not defined by this Statute are given in acts of National Committee and Presidency in accordance with the Statute. Authentic representation of the regulations of Statute is done by National Committee, suggested by Presidency. Authentic representation of paragraphs of Statute becomes an integral part of this Statute from the day when passed.
